Legal rules for processing personal data
When processing personal data, BubbleTabs is, among other things, bound by the following laws and regulations:
- General Data Protection Regulation (GDPR) and
- GDPR Implementation Act.
Your rights
You have various rights under the law and regulations. We list the rights for you below.
Right of inspection
You have the right to view the personal data processed by BubbleTabs.
Correction and deletion right
You have the right to have data changed or deleted if the data is not (no longer) correct, or if the processing is no longer justified.
Right to object
The right to object means that you can object to certain processing of personal data due to your specific situation. You have this right for all processing that is not based on:
- Your consent;
- Taking pre-contractual measures at your request and/or the execution of the agreement(s) concluded with you;
- Compliance with legal obligations or
- Protecting the vital interests of yourself or others.
If you object to the use of your personal data to inform you about BubbleTabs activities and similar ("direct marketing") processing, we will always honor this objection. Your data will then no longer be used for direct marketing purposes.
If you object to other forms of processing of your personal data, we will assess whether we can accommodate your objection. In that case, it is up to Profeit to demonstrate that, despite your objection, we still have a legitimate interest in continuing to process the personal data. If this weighing of interests is in your favor, we will cease processing the data.
Right to restriction
Under certain circumstances you also have the right to restrict the processing of your data. In short, this means that Profeit temporarily “freezes” the processing of the data. You can invoke this right in four situations:
- Awaiting the assessment of a correction request;
- If data should actually be deleted but you do not want deletion;
- If BubbleTabs no longer needs the data while you still need the data for (the preparation for) a lawsuit and
- Awaiting the assessment of an objection.
Right to data portability
You have the right to receive (back) the data you provided to BubbleTabs in a common file format. This right only applies to the personal data that we process on the basis of your consent or an agreement concluded with you. Moreover, the right only applies to data that we already process in digital form (not to analogue processing). You are free to subsequently pass on that data to another party.
If there is a link between our systems and the systems of the third party to which you want to transfer the data, we may be able to arrange this transfer directly on your behalf. Please inquire about the possibilities.
Withdrawal of consent
For the purposes numbered seventh above, we process your data on the basis of your consent. You have the right to withdraw consent once given at any time. We will then immediately stop processing.
Withdrawal of consent has no retroactive effect. All processing that has already taken place therefore remains lawful.
Exercise of rights
Exercising the rights is free of charge for you, subject to misuse. You can exercise the rights by contacting us using the contact details below.
Terms
In principle, we will answer your questions/requests within one (1) month. If it unexpectedly takes more time to answer your question/request, we will inform you about this within one (1) month. Due to the complexity of the requests and/or the number of requests, the response time may be up to three (3) months in total.
Identification
We may ask for further proof of your identity for all questions/requests. We do this to prevent us from providing personal data to the wrong party or from incorrectly making changes to the processing of personal data. To ensure that your request is handled as smoothly as possible, we request that you send a copy of your proof of identity in advance.
Individual consideration for each request
We would like to point out that the rights described above are not absolute rights. There may be circumstances that mean that we cannot respond to a particular request. We will always assess every request on its own merits. If we do not (or cannot) respond to a specific request, we will of course inform you of this with reasons. In that case, you can then possibly go to court.
The right to object to the use of data for direct marketing purposes is absolute. Unsubscribes from our commercial communications will therefore be honored in any case.
